This study explored the impact of financial literacy on potential entrepreneurs' intent in Saudi Arabia. It also examined saving behavior as a mediator in the relationship between financial literacy and entrepreneurial intention. The study's data were collected by an online questionnaire sent to a sample of 270 potential entrepreneurs at Abqaiq Applied College, affiliated with King Faisal University. Data analysis was done using partial least squares structural equation modeling. According to the findings, there is no direct relationship between financial literacy (...) and entrepreneurial intent. The study has dealt with the theoretical context of the meaning of fame in language and term; also has shown that fame requires authenticity regardless of whether it is a word, narration or a classified work. On the other hand, it has examined that those, except for those who are examined with evidence, who are not famous among them will not be judged to be authentic or not. Later, it has pointed out the effect of fame on the correction of (...) the narrations and emphasized that fame is an important factor about the accuracy of the books in relation to their authors; and also sought an answer to the following question: Is fame the only factor in this or not? Thus, the problematic and some objectives of the study have been fulfilled, and the signs of the book’s finding of fame with the related author and the reasons that require this fame has been expressed. Among the indicators of the book’s fame from its author, arguments such as the narration from a group, the author’s clear statement that the book belongs to him, and the attribution of the book to him by his immediate surroundings in his own time have been mentioned. The study has examined six examples from the first three centuries, with the idea that the subject would be practical. In each century, two books were selected, and it was determined that one of them would be correct due to its reputation in relation to the author, and that the attribution of the other to the author will not be correct, since the other does not have a reputation. It has been determined that the attribution of his risālah about advices attributed to al-Imām Mālik and the book named al-Radd alâ'z-Zenādika wa'l-Cehmiyya, which is attributed to Imam Ahmed, are not valid. This study examined the relationship between urban culture and street vending. Prior research on this topic is limited and inconclusive. Therefore, we have proposed an integrated model to test the positive effect of urban culture on street vending using multiple mediations of consumption patterns, resistance, and microfinance. We tested a sample of 425 responses that reflect the public opinion in Baghdad, Iraq. These responses were collected between September and November 2018. A partial least squares–based structural equation modeling is employed to (...) test the validity of measurement models and the significance of the entire structural model, predictive power, and mediation analysis. We found that resistance mediates the effect of urban culture on street vending; low-income consumption and resistance sequentially mediate the effect of urban culture on street vending, while resistance mediates the effect of a lack of microfinance on street vending. The direct impact of culture on street vending is not significant, and a lack of microfinance positively influences the pervasiveness of trading on streets. This study contributes to the extant literature as it proposed and tested a novel and comprehensive model to analyze the relationship between urban culture and street vending, simultaneously examining the effects of culture, consumption, resistance, and microfinance on street vending. Ethical scandals, as well as unethical behaviour, are becoming major concerns in recent times. Thus, this study focused on the role of ethical climate and employees’ moral identity. Specifically, this study examined the mediation effect of ethical climate on the relationship between ethical leadership and employees’ ethical behaviour. Also, the study investigated the moderating role of employee moral identity on the relationship between ethical climate and employees’ ethical behaviour. Data were collected from 620 full-time employees working at thirty-three Iraqi organisations (...) from five Iraqi provinces. These organisations were from various industry sectors such as manufacturing, retailing, medical, insurance, information technology, legal, finance, and telecommunication sectors. The study found that ethical leadership impacted on the ethical behaviour of employees and the ethical climate also significantly mediated the relationship between ethical leadership and employees’ ethical behaviour. The moderating role of moral identity on the relationship between ethical climate and ethical behaviour was found to be insignificant in this context. (shrink)

Zakat is mandatory contribution in Islam. It is the command (Pherman) of Allah revealed in holy interaction/discourse of Prophet Mohammad (PBUH) with Allah. Islam stands for social and economic solidarity among the followers of Islam. It seeks to provide the basic needs of the individual out of the Zakat contribution pool. For this study, the aim is to discuss the noble and holy idea of employing zakat funds. The employment of Zakat funds are permissible in certain forms and prohibited in (...) some. This distinction is made from the perspective of Islamic jurisprudence. The study proceeded with this aim and reached the following results: (i) the employment of zakat funds is undoubtedly meant for helping the poor, disabled, destitute, and sick or orphaned individuals. (ii) Zakat has five forms in which Zakat funds are deployed/dispensed; (iii) Zakat funds take the form of investment; (iv) Zakat funds are meant to be spent in public interests; (v) Zakat funds are converted into endowments. The forms of spending (iii) and (v) are prohibited by some jurists. They contend that the permissible forms of fund-employment are: (a) providing a vocational tool (felicitation giving equipment such as tools, instruments or other things) to the needy; (b) establishing projects that benefit the poor as a privileged group/class. The study makes recommendation that Zakat controlling institutions should take care of employment of Zakat resources-pool/reservoir in providing jobs to the unemployed poor and others eligible as per Islamic philosophy and the provision of vocational tools, instruments or equipment so that the eligible poor skilled individuals are able to work more efficiently to earn their livelihood. Street vendors are prominent on public streets and in traditional markets in most developing countries. They raise significant problems for public authorities, residents, pedestrians, and formal retailers. Their informal business is problematic, leading to conflicts and sometimes violence. Moreover, unlicensed street vendors employ children and women and are accused of counterfeiting and drug trading. However, they participate in reducing poverty and unemployment. The current data article aims to formulate a public perception on the problematic issue of street vending pervasiveness by (...) describing a survey dataset on street vending and its main driving factors. Street vending has traditionally be examined by linking it with one or more determinants; thus, the dataset covers poverty, lack of education, immigration, unemployment, urban culture, low-income consumption, resistance, and lack of microfinance as latent constructs. Five measurable variables are introduced that reflect each construct. All variables are measured via seven-point Likert scales. Using a Google Form, 425 responses were collected that reflect the attitudes of the general public in Baghdad, Iraq. The investigation of users' satisfactions and intentions in using the services provided by commercial banks needs to be focused on internet banking, since this is the widely used banking service. This paper analyzed the satisfactions and behavioral intentions of Malaysian customers in using Internet Banking, applying the Information System Success Model by the integration of adoption and application technology theory. Some criteria, which were taken into consideration, are as follows: perceived Risk, facilitating Conditions, Price, Performance expectancy, Information Quality, Service Quality, (...) and System Quality. These aspects are important to measure customers' satisfaction and behavior toward Internet and Online Banking. A sample of 362 valid responses, consisting of Malaysian customers who used E-Banking, was used for the purpose of data collection. The relationship between customers' satisfaction and factors influencing their contentment in using Online Banking was investigated. In order to evaluate this, a model called “Structural Equation Model ” was developed and used. Findings showed that most of the Online Banking users were satisfied with the system. Hence, it proves that Online Banking System was generally accepted in the Malaysian community. However, this current research is solely focused on the Malaysian community. Therefore, it may provide the necessary grounds for the study of internet banking accreditation, some useful information for the practitioners, policy makers, and the researchers to improve the system of online banking in Malaysia only. Background Triage in the emergency department (ED) is a crucial procedure that establishes the urgency of patient care based on symptoms at presentation. Although the efficacy of triage nurse training programs varies, their goal is to increase the precision and efficiency of their decision-making. Aim With a focus on research done between 2019 and 2024, the systematic review attempts to evaluate the effect of training programs on the accuracy and efficiency of triage nurses in emergency departments. Method We conducted a (...) thorough search of the PubMed, EMBASE, and Web of Science databases to find pertinent research. Studies assessing training treatments for triage nurses and reporting accuracy and efficiency-related results were included in the inclusion criteria. Both the quality assessment and data extraction were carried out separately by two reviewers. Result Ten studies that used a range of triage training techniques and covered a variety of geographic areas satisfied the inclusion criteria. Research findings consistently showed that, despite variations in study designs and outcome measures, training programs increased triage accuracy and efficiency. Interventions included clinical decision support system integration, training based on simulation, and conventional classroom-based instruction. Conclusion By increasing decision-making efficiency and accuracy in patient evaluation, training programs greatly improve the performance of triage nurses in emergency departments. To improve comparability and support evidence-based policies, future research must standardize training methodologies and outcome measurements. (shrink)

This study seeks to explore the major errors that frequently emerge when novice translators translate technical texts, namely legal documents released by the Department of Lands and Survey in Jordan. The goal behind this investigation is to improve legal translation training, develop students’ drafts based on the types of their mistakes, and deliver a message to curricula designers in the field of legal translation. To this end, 20 Jordanian novice translators (MA students) are chosen from two private universities to translate (...) three legal documents from Arabic into English. The main findings revealed that different problems emerged, namely the participants’ inability to translate near-synonym technical terms, grammatical problems, and stylistic problems at both lexical level and sentence level. These findings are hoped to be insightful for both learners and teachers. A number of pedagogical recommendations are proposed by the researchers to develop learners’ competence and reach a professional level and open the venue for trainers to achieve advances in the quality of the target text and in the translation teaching–learning process. [fr] La présente étude a pour but de contribuer, par l´examen des textes du dīwān du plus ancien poète populaire mauritanien connu, Saddūm Wuld Nd̆aṛtu, à identifier le vocabulaire ancien et à en expliquer la signification. Nous interrogeons ce dīwān en tant qu´ unique témoin conservé de l´époque de l´auteur (18ème siècle) pour qu´il nous aide à identifier dans ses poèmes les mots anciens qui sont depuis longtemps tombés en désuétude et sont aujourd´hui considérés comme des archaïsmes, des termes étranges (...) ou peu familiers à la plupart des locuteurs ou à tous. L´étude comprend, d´une part une description du contexte historique dans lequel vivait le poète et, d´autre part, une brève présentation du contenu du dīwān, avant d´aborder le sujet principal, à savoir le vocabulaire ancien du ḥassāniyya contenu dans l´ouvrage. The dynamic balance is a significant skill in all age groups and it is required for regular daily activities, such as walking and running. Therefore, this study aimed at identifying the differences in concentration of attention, aerobic endurance and dynamic balance among female students in age group (9-12) years. As well as the relationship between attention concentration and ability of female students on aerobic endurance and dynamic, balance. To achieve the objectives of the study the researchers used the descriptive approach (...) on a sample consisting of (130) female students within age group (9-12) years in Khawla bint Al Azur school, Amman. For study data, the researchers used the mental abilities test, aerobic endurance test and dynamic balance test. To Processing the study data, the researchers used means, standard deviations, ANOVA, Scheffe and correlation coefficients. The results showed that there were statistically significant differences between the means of the results in the concentration attention ability, aero aerobic endurance and dynamic balance and for the benefit of category (11-12) years. Consequently, there were statistically significant correlation between the level of concentration of attention abilities and the level of the aerobic endurance and the dynamic balance of the students in age group (9-12) years. Therefore, researchers recommend that female students in the age group (9-12) should be encouraged to exercise physically for coordination abilities and physical abilities. (shrink)

This study examines the frequency of consanguineous marriage and the coefficient of inbreeding in the United Arab Emirates. The study was conducted in Al Ain and Dubai cities between October 1994 and March 1995. A sample of 2033 married UAE females aged 15 years and over participated. The degree of consanguinity between each female and her spouse, and the degree of consanguinity between their parents were recorded. The rate of consanguinity in the present generation was high with a coefficient of (...) inbreeding of 0·0222. The commonest type of consanguineous marriage was between first cousins. Double first cousin marriages were common compared to other populations. The consanguinity rate in the UAE has increased from 39% to 50·5% in one generation. The level of consanguinity was higher in Al Ain than in Dubai. (shrink)

Informed consent (IC) represents one of the fundamental rights of patients in healthcare. An essential aspect of the IC process is providing patients with equal access to information to enable them to make the right decisions. However, failure to obtain IC undermines patient autonomy, lowers patient satisfaction, increases risks, and negatively affects the patient’s trust in healthcare providers. This study aims to evaluate the surgical informed consent (SIC) process from the patient’s perspective both for emergency and elective surgeries in obstetrics/genecology (...) in Saudi Arabia. This is a quantitative cross-sectional study. The study population included all hospitalized female patients who had undergone obstetric or gynaecological surgeries, from February 2021 to March 2021. The total sample size was 156 female patients. Most of the participants were married (96.2%) and unemployed (80.1%). The most performed surgery was caesarean Sect. (84%). Most of the patients were satisfied with their SIC experience which represents over 85%. No significant difference has been found between the elective and emergency surgeries. However, person-in-charge of SIC administration and the time provided to sign the IC were deemed to be significant predictors. Based on the findings, it is recommended that physician take responsibility for the SIC administration rather than an unknown provider. It is also recommended to provide the patients with adequate time to understand the SIC. Furthermore, ensuring the availability of emotional support is critical for enhancing the patient experience. This study aims to analyze the social, health, and economic factors affecting the low fertility rate among women in the United Arab Emirates (UAE). The study seeks to answer the following question: What are the social, economic, and health factors that affect the low fertility rate among the Emirati women, from the point of view of female university students? Using a snowball sampling method, we collected data from 212 working female students at a university in Abu Dhabi Emirate. Findings indicate (...) that undergraduate education demands a significant amount of time for married females. Among the respondents, 94% acknowledged that a woman’s pursuit of higher education could divert her attention from fulfilling familial duties, potentially resulting in declining fertility rates. Moreover, 62% of the participants believed that undergraduate studies impact fertility. When examining the age of marriage, it was noticed that most married women (81%) were between the ages of 15 and 25, suggesting that age at marriage does not, significantly, affect fertility. Approximately 51% of the participants suggested that their husband’s absence from work might affect fertility outcomes. In addition, living in a separate household demonstrated a positive correlation with higher fertility rates than when living with parents. By analyzing the respondents’ geographical distribution, we found that the urban population accounted for the most significant percentage (81%). This observation implies a potential correlation between the city’s characteristics and fertility rates. Furthermore, the study identified a significant relationship between the husband’s desire to control or postpone reproduction and fertility rates. Our results align with the study population’s beliefs regarding the detrimental effects of malnutrition and unhealthy dietary patterns on fertility. Our study recommends developing policies for women’s work–life balance, social support networks, and tackling economic barriers to address the declining fertility rate in the UAE. (shrink)

Reproductive health technology allows married couples who experience infertility to have a child through assisted reproductive technology (ART), such as the in vitro fertilisation (IVF) process. The transfer of the extracted embryo to the woman’s womb is called surrogacy technology (gestational surrogacy). The legality of the practice of surrogacy is still questionable, both on a national and international level. This research discussed the legality of surrogacy in some religious countries, focusing on Indonesia. This research used normative juridical research methods or (...) literature review through a comparative religion-legal approach. This study indicated that most do not have a specific legal instrument regarding surrogacy practice. International law also does not have a standard legal instrument regarding the legality of surrogacy. Legality is determined by each religious country’s national laws and customs. For example, Indonesian law prohibits this practice implicitly under Law No. 36 of 2009 concerning health. The United Kingdom legalised surrogacy through the Surrogacy Agreement Act 1985, which was amended to the Human Fertilization and Embryology Act 2008, Greece through the Greek Legislation Law 3089/2002 and Law 3305/2005, and India through the 2019 Surrogacy Regulation Bill. Those countries have their limitations and characteristics that rule surrogacy. Surrogacy is indeed a technological advancement in the health sector. However, for countries that are influenced much by religion, technological advances sometimes conflict with the culture and the belief that has long been followed by most of the population. For Indonesia, the largest of Sunni Islam ruled surrogacy against the law. Next, Iran, as a Shia Islam country, ruled that surrogacy is a legal action.Contribution: The research provided information and knowledge regarding the different settings of surrogacy practice. The current study sought to examine emotional manipulation and its connection to symptoms of narcissistic personality disorder among couples, and whether there are statistically, significant differences based on the variables such as gender, age, duration of marriage, and educational level. The study involved a sample of 924 married couples, selected through the descriptive correlational approach. The findings revealed a moderate level of emotional manipulation and symptoms of narcissistic personality disorder among couples. They also showed statistically significant differences in emotional manipulation (...) and narcissistic personality disorder symptoms based on gender, favoring males; duration of marriage, favoring those married for less than (10) years; and educational level favoring those with secondary or less. No statistically significant differences were found based on age. Moreover, a positive and statistically significant relationship was identified between emotional manipulation and symptoms of narcissistic personality disorder in couples. Based on these findings, the researchers recommend organizing lectures and seminars to educate couples about the negative effects of emotional manipulation and various types of symptoms of narcissistic personality disorder appearing in the marital relationship. This study aimed to clarify the prophetic rules concerning the relationship with non-Muslims in the Islamic society. The descriptive approach is used, and the findings revealed that the Prophetic controls in this regard are intellectual and cultural controls such as endorsing religious pluralism and ensuring learning and education without corruption or promoting atheism, as there is no compulsion in religion while guaranteeing the right to build and restore churches and places of worship. The study also reveals political and human rights (...) controls such as respect for a decent life, and the sanctity of the human soul, which cannot be robbed or diminished except under legal conditions. These controls appear in prominent rights such as the right to citizenship, the right to political and professional work, and the right to justice. There are also economic and financial controls such as justice in acquiring rights and performing duties in a way that guarantees non-Muslims their economic stability. These include the right to protect money, freedom to work and earn, the right to guarantee the treasury, and their right to alms from rich Muslims. The results also showed social and family controls such as good family cohabitation and maintaining social ties and bonds. These controls are represented in the right to cohabitation, and the right to marry and divorce. (shrink)

ObjectiveTo examine body image perception and the associations of body dissatisfaction with socio-demographic and lifestyle factors among Saudi women attending fitness centers in Riyadh.MethodsSaudi females aged 16 years and older were recruited from 12 randomly selected fitness centers in Riyadh, using stratified clustered sampling technique. Height and weight were measured to calculate actual body mass index. A previously validated instrument was used to collect socio-demographic and lifestyle variables including physical activity, sedentary behaviors, sleep and dietary habits. Stunkard Figure Rating Scale (...) silhouettes were used to assess perceived and desired body shape.ResultsThe participants had a mean age of 29.2. The majority were not married, with no children and had college degrees. While 63% were overweight or obese, nearly 40% of women underestimated their perceived body shape. The majority of respondents were dissatisfied with their body shape including 68% of normal weight women. Females who had BD were significantly older, had higher BMI, reported more weight loss attempt and had expended less time in vigorous and total PA than those who were satisfied with their body shape. However, when adjusting for socio-demographic variables, logistic regression analysis revealed significant associations of BD with higher BMI, shorter membership duration of fitness club, and reduced dairy products and energy drinks consumption.ConclusionExcept for BMI and decreased dairy products and energy drinks consumption, many lifestyle behaviors did not associate with BD among Saudi females attending fitness centers. The findings can inform healthcare providers when intervention strategy is implicated for females with BD. Future studies should compare the associations of BD with lifestyle behaviors between males and females attending fitness centers and seeking weight loss. (shrink)

This study aims to identify the potential predictors (i.e., financial well-being, mindfulness, and marital duration) of relationship satisfaction among married couples in Malaysia. Respondents were 156 Malaysian married couples from different races – Malay, Chinese, Indian, and others. All respondents responded to three questionnaires which are In Charge Financial Distress/ Financial Well-Being Scale (Prawitz et al., 2006), Mindfulness Attention Awareness Scale (Brown & Ryan, 2003), and Couple Satisfaction Index (Funk & Rogge, 2007). A significant positive relationship was found between financial (...) well-being and mindfulness with relationship satisfaction, meanwhile, no statistically significant relationship was found between marital duration and relationship satisfaction. Moreover, mindfulness is established to be the strongest predictor of relationship satisfaction among married couples in Malaysia. This result emphasized the role of mindfulness within the context of development and sustainability of marital relationships satisfaction in addition to general well-being. (shrink)

The study examined the relationships among some demographic factors, self-compassion and interdependent happiness of the married Hindu couples. Using a correlational research design, 600 participants (300 couples) were chosen by a snowball sampling. Self-compassion Scale (Neff, 2003b), Socioeconomic Status Scale (Aggarwal et al., 2005) and Interdependent Happiness Scale (Hitokoto & Uchida, 2015) were used to collect data. Findings revealed that some demographic factors such as age, years of marriage and number of family members were positively correlated with self-compassion while the (...) number of children and socioeconomic status were negatively correlated with it. Age, years of marriage and the number of children had a positive relationship with interdependent happiness. Self-compassion evinced a significant positive correlation with the interdependent happiness of the couples. The nature of family and self- -compassion accounted for significant variance in the scores of interdependent happiness of the couples. The study constitutes one of the limited studies which assessed the relationships among a set of demographic factors, self- -compassion and interdependent happiness on a sample drawn from a collectivistic society. The results have been discussed in the light of extant theoretical and empirical findings of self-compassion and interdependent happiness. The findings may have significant implications for understanding positive life outcomes of people with self-compassion belonging to a collectivistic culture. The theory, practise and policy implications of the findings have been discussed. Directions for future research have also been provided along with some limitations of the study. (shrink)

The type of ‘Al-isnād al-āli’ (higher chain of authority) which has great importance for the science of ḥadīths that constitutes the second best source of the Islam, expresses the value in terms of its proximity to the period of the Prophet Muhammad (peace be upon him). If ḥadīth has ‘al-isnād al-āli’ in the works of the scholars provides us with assurance on the intend of the ḥadīth. For this reason, the values of the works of those authors who have constructed (...) their works with al-isnād al-āli undoubted in the science of ḥadīth. However the work of Abu al-Jahm al-Bāhilī’s (d. 228/842) named al-Juz‘ had that kind of ḥadīth, it has not appreciated by scholars, he could not get enough attention in his period and after it. His work contains famous scholar al-Layth Ibn Sa‘d’s (d. 175/791) narrative who claimed by ḥadīth scholars that his students neglected and omitted his ḥadīths and knowledge. Al-Layth Ibn Sa‘d was known doing transmission by written copies. The similarity of al-Layth Ibn Sa‘d narrations in al-Juz‘ with al-Layth narrations, which are also found in other sources, strengthens the claims of the existence of a narrative process based on the written texts in the early periods. In this study, these transfers of Abu al-Jahm reflected on other works will be examined and tried to build narrations of his teacher al-Layth Ibn Sa‘d. country, we can say that the article will contribute to the studies of the history of religions.Summary: Ḥadīth works written in the third century of hijri are the most distinguished sources. The most fundamental works in the science of ḥadīth were written in this time. In the following period, numerous studies have been committed to paper on them. One of the eminent works is the named al-Juz’, which belongs to Abu al-Jahm al-Bāhilī (d. 228/842). The author was not a person that was taken into consideration much during his time. It is possible to that he has been criticized about his scientific proficiency (al-Jarh). Nevertheless, al-Juz’ attracts attention due to the fact that it contains the type of ‘al-Isnād al-āli’ (higher chain of authority). Al-Isnād al-āli, which means access with the least number of narration from the author to the Prophet has very major role to determining of being dependable and certainty of the ḥadīths. The work of Abu al-Jahm which contains the ‘al-Isnād al-āli’ did not attract enough attention. However, another value of the al-Juz‘ is that its been included the narration of famous muhaddith Al-Layth Ibn Sa'd (d. 175/791). He is one of the valued mujtahid imams who have played an active and important role in second century of hijri. Al-Layth's narrations have been available insufficient amount present day. At this point the al-Juz‘ of Abu al-Jahm has great important because it contains many narrations of his shaykh Al-Layth Ibn Sa'd.The Juz‘ seems to has attracted the attention of the ḥadīths scholars in the following period. Indeed, various authors had the get authorization to narrate al-Juz‘. Furthermore, it is also known that some scholar in his period utilized his narration in their own study. For in¬stance, it was declared by Ibn Ḥajar (d. 852/1449) that al-Bukhārī (d. 256/870) had a narra¬tion belonging to Abu al-Jahm in his work ‘al-Ṣaḥīḥ al-Bukhārī’ with a muʻallaq chain (Omit¬ting his name). In the following periods, we come across famous muhaddith such as Aḥmad b. Ḥanbal (d. 241/855), al-Ṭabaranī (d. 360/971), Abū Bakr al-Marwazī (d. 292/905), al-Dāraquṭnī (d.385/995) and al-Bayhaqī (d. 458/1066) who received qualify of Juz's narra¬tion. Although the narrations of Abu al-Jahm are included in the prominent works of schol¬ars, it is clearly seems that the Juz‘ had not enough value except being procure as a written text. As far as we determined there are eleven narration of Abu al-Jahm in the main ḥadīth sources. In addition, we detected that some studies which contain some ḥadīth of al-Juz’ are list them in the same layout and order. This situation indicates that al-Juz’ is owned by these people as a duplicated edition and they narrated by not only orally transmitted but also spread by writing copy. This inference strengthens the theory which conceived by Modern researcher Fuad Sezgin (1924-2018) that ḥadīth transmission had conducted not only through oral transfer but also through written copies.Even though he lived in a very active time of oral transmission of ḥadīth and the time of specific journey for learning and pursuing ḥadīth, it is seen that Abu al-Jahm formed his Juz‘ from the ḥadīths that he procured only from his six shaykhs. That was quite less amount in that period. Juz‘, has an ʿAlāʾ al-Rijāl classification (ranked according to narrators) as ex¬pected in his period method. Abu al-Jahm began his study with his shaykh Al-Layth Ibn Sa'd’s narration, then completed with Sufyān ibn ʿUyayna’s. Juz‘ includes 112 ḥadīths. Ex¬cept two muʻallaq isnāds (omitting one or more narrators), all of ḥadīth has muttaṣil isnāds (narrators in the chain connected each other without omitting). Al-Juz‘ available nowadays in a published form. It seems that some of ḥadīth datas included in the Juz‘ have content against Islamic juris-prudential judgements. For example, the Prophet’s sayings ‘One or two swallow of breast milk does not make haram’ and ‘Nobody can fast or pilgrimage for the benefit of someone else’; allowing to Subay‘a al-Aslamī to marry without waiting her ‘iddah (waiting period of a woman after the death of her husband or divorce); when she gave birth, ʿUthmān b. ʿAffān’s permission to al-Rubay‘a bint Mu‘avvidh not to wait her ‘iddah; when ʿAbd Allāh b. ʿUmar has nasal bleeding he leaves the prayer, goes to wash, then back and continue where he leave off, without taking ablution; and describing marriage with polytheist women as for¬bidden (ḥarām). Of course, all this information must be examined within the framework of Islamic jurisprudence. However, Abu al-Jahm stands alone (tafarrūd) in such issues, it can be seen as the reasons to be recognized as a censured person (majrūḥ).Al-Juz‘ included 66 isnāds of Al-Layth Ibn Sa'd’s narration. Therefore it leaves behind all the works that compile the narration of Ibn Sa'd. That is why, we hypothesize that Juz‘ is a form of Al-Layth’s study that has survived to the present days. As a matter of fact, the muhaddiths who included the narrations of Al-Layth in their works, especially Ibn ḳuṭlūbughā could not ignore the Juz‘ of Abu al-Jahm; on the contrary, they took it as reference. In this case, it should be said that Abu al-Jahm al-Bāhilī is a loyal follower of Al-Layth and the word at¬tributed to Imām Shāfi‘ī and characterizing Al-Layth’s followers with disloyalty is invalid. The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

There are some radical practices of asceticism, such as wearing ṣūf (wool clothes), traveling without provisions, choosing to be single, and avoiding earning a living by working, which were generally seen in the 2nd century A.H. and were subject to criticism with the formation of classical Ṣūfism. Criticisms of these practices have started to appear in the literature since the 3rd century A.H. Early Ṣūfī writers such as Al-Ḥakīm al-Tirmidhī, Muḥāsibī, Abū Saʿīd al-Kharrāz, al-Sarrāj focused on this issue and criticized (...) these practices. How are these practices of ascetics viewed in the sects that were formed and spread in the 6th and 7th centuries? Our research seeks the answer to this question, but limits it to the example of Abū l-Ḥasan al-Shādhilī, the founder of Shādhiliyya. This question is important in two respects: First of all, it is investigated whether the determination of some researchers that al-Shādhilī taught comfort in the face of worldly blessings is also correct. Because, among contemporary researchers, there are those who believe that al-Shādhilī wears ostentatious clothes, rides horses, encourages economic competitiveness, and is therefore open to benefiting from worldly blessings to the fullest. Secondly, it includes an investigation of the validity of the belief that these practices belong to an early period in the history of Sûfism and have been completely abandoned over time. Although al-Shādhilī seems to have completed his spiritual education in Morocco with his sheikh, he later went to Tunisia with the latent command of his master. We see that in his first years in Tunisia, he went into seclusion in a cave and was completely isolated from the society and engaged in worship in a way that reminds us of the practices of the early ascetics. But in the second phase of his life in Tunisia, he went to the city on a spiritual sign, socialized, started to give sermons to people, and started to behave more flexible about eating and drinking. al-Shādhilī specifically states that he did not prefer socialization at this stage, but with a spiritual sign. Later, he went to Egypt again with a spiritual sign and got married there, started to deal with agriculture, and continued to socialize by establishing relations with the rulers. Therefore, it can be said that this new social period is a break both from the radical practices of the early ascetics and from the early period in Tunisia itself. It is also seen that in this new period of al-Shādhilī, he did not wear the clothes of ascetics like sūf (wool clothes) and did not want his followers to wear them. He also encouraged to have a profession and was generally against traveling without provisions. But there are two points to be noted here: First, these milder and more comfortable practices should not lead to a search for comfort and luxury. He continued to keep his distance from worldly blessings and to advise asceticism. Secondly, he had some of his distinguished disciples make some practices of the ascetics. The reason for the existence of these seemingly contradictory practices is that while he recommends moderate and sustainable practices to the general public and his followers, he can make the specialized sūfis more strict and difficult practices. While he was encouraging work and earning in general, not ignoring experience, including avoiding work; not ignoring seclusion while leading to sociality in general; while generally suggesting to resort to occasions, he also follows a path of implementing and enforcing radical practices such as traveling without food. Thus, al-Shādhilī is able to encompass all the seemingly incompatible practices of the previous sūfi accumulation with a point of view of spiritual rank and hierarchy. (shrink)

During the Mamlūk period (648-923/1250-1517), some developments such as the support of the state dignitaries for scholarly activities, the interest of the ʿulamā to the Mamlūk geography and the establishment of many scientific institutions increased the interest in scholarly activities in society. In this period of intensive scholarly activities, women also started to increasingly take part in this field, and as a result, many female scholars were trained. The fact that women scholars were encountered among the teachers of the famous (...) scientists of the period is a clear proof of this situation. As a matter of fact, the teachers of Najm al-Dīn Ibn Fahd, one of the famous muḥaddiths and historians of the 9th (15th) century, set an obvious example for this. Sixty-seven of his four hundred ninety-seven teachers were women. Najm al-Dīn Ibn Fahd, a member of a prominent ʿulamā family of Mecca, traveled to different cities in the Mamlūk geography and took lessons from many teachers, men and women. What is more valuable for our subject is that he wrote a work called Mu’jam al-shuyūkh, which contains extremely important information about his teachers. This article tries to assess women's participation in scholarly activities and social positions in Mamlūk society, based on his female teachers. This work, made up of two parts, first deals with women’s opportunities to pursue academic studies and their subsequent contributions to science. The second part is about their position in social life which stemmed from the families they belonged to and from their marriages. In this article, in which sixty-seven female scholars of Najm al-Dīn Ibn Fahd are discussed, some important results have been reached. This look into his sixty-seven female teachers shows how widespread women’s relationships with scholarly circles were in Mamlūk society, and that especially girls of families with scholarly traditions were included in academic circles from a young age. These girls were able to get their initial education from close relatives and then they were able to connect to academic circles easily via family relationships, taking courses with many scholars including women. Women have been instrumental in the transfer of knowledge more so than its production. Their efforts both during their studies and as scholars were focused on ḥadīth transmission. It is difficult to pinpoint the exact reason why ḥadīth sciences were the focus, but one can say that the ubiquity of ḥadīth sessions and their ease of accessibility must have been a factor. It is seen that young girls who participated in these sessions were encouraged to study with older scholars, thereby acquiring a strong isnād chain and becoming a source of information in later years for the transmission of knowledge. However, it is hard to say that every woman who got some education took a role in knowledge transmission. One can even claim, based on Najm al-Dīn Ibn Fahd’s female teachers, that a lot of women in academic circles did not take a role in knowledge transmission as scholars, despite their potential. The fact that no official institutions are mentioned with regard to women’s acquisition and transfer of knowledge may be indicative of the importance of teacher-student relationships rather than institutions, or, it can be that women were more active outside of these official institutions. Also, the fact that most of Najm al-Dīn Ibn Fahd’s female teachers were all taught by several common teachers shows the liveliness of academic activity outside of official institutions. There is very little narration regarding the social lives of women who were engaged in scholarly activities. Among the most important reasons why this is so is the desire to put their scholarly competencies to the forefront. However, it is possible to get some information about their families and marriages for many of them. One can see that Najm al-Dīn Ibn Fahd’s female teachers generally married men who were also engaged in scholarship. The fact that women, especially those in the scholarly class, married from among their relatives must have been related to this. All of the married women except one have at least one child. While divorce is not too common, marrying again as a result of the death of a husband or as a result of divorce is not rare. (shrink)

Some of the human needs are more important than others in order to be inevitable. One of these needs which cannot be avoided is the need for belonging to any authority. Whatever the name, religion, nation, homeland, flag etc. all these concepts are the reflections of the sense of belonging that comes with human existence. This article will discuss how Kuwaiti novelist Saud Alsanousi reflects the crisis of a child who is born from a secret relationship with a Filipino woman's (...) son who came to Kuwait as a housekeeper in Kuwait. When he returned to Kuwait, where he carried his passport and felt himself unfamiliar in the Philippines because of his physical structure and the Arabs, he was again excluded by his relatives because of his Filipino mother. The novel tries to draw attention to the socio-economic problems of workers coming from South East Asia to the Gulf countries, especially from the character of Jose, who has a nauseous mood due to the uncertainty between Philippine-Kuwait and Christian-Muslim affiliations. The introduction of foreign workers who constitute more than half of the population in the Gulf countries will be reviewed. Afterwards, a short summary of the novel will be given and the main theme of the lack of disability will be analyzed. Summary: In 1973, Syria and Egypt started a air strike against Israel in order to recover their lost territory in the previous wars and their reputation in the international area. Some Western countries -especially the United States- have shown all kinds of military aid to Israel in the face of this attack. Thanks to these aids the Syrian and Egyptian armies have not achieved their intended goals. This attitude of Western countries to Israel has attracted the reaction of other Gulf countries -especially the Saudi administration- which has a large amount of oil reserves. Gulf countries -which have not gotten a strong military option- tried to use the oil in their hands for the first time as a political trump card. These oil-exporting countries have reduced oil production in response. As a result, the economies of Western countries which were industrialized and dependent on oil have been negatively affected by this decision. In contrast, Gulf States have gained a sudden and massive fortune due to oil prices rising three or four times. The Gulf States, which have led this wealth to development in many areas like education, health, urbanism, etc. The need for qualified staff in these fields was supplied by other Arab countries such as Egypt, Syria, and Sudan. However, as the years passed oil prices decreased and so oil revenues decreased. This reduction led the Gulf States -which have only oil-based economies- to look for cheaper labor. While the foreign employment provided from the Arab countries previously later this need has begun to supply from far East Asian countries which are economically very weak. Vast number of employees emigrated to the Gulf countries to work in the labor service sector with very low wages especially from the Philippines, Indonesia, Bangladesh, and Malaysia. This segment -which has employed with very low wages- has been subjected to injustice and discrimination. The injustices faced by the Far East Asian foreign labor force deprived of social rights have been the subject of many painful stories over time. The modern novel -which aims to reflect the life and the human being with all its details- has reflected the stories of the victims of that employers. Saq al-Bamboo (Bamboo Bar) is one of these novels which has published by Kuwaiti writer Saud Alsanousi in 2012. Within a short time after the publication of the work the novel was interested in the Arab world and in 2013 he was awarded the International Arabic Novelist Prize. The novel is consisting of five chapters and each chapter is divided into three sections 1,2,3... The author conveys the crisis of unetnicity from Jose’s chracter who was born from a Filipino mother and a Kuwaiti father. A translator named Ibrahim Selâm -which is a translation of the souvenirs and diaries belonging to Jose from the Philippine language to Arabic is intended to increase the realism of the work. Josephine -who came to Kuwait to work from the Philippines- was settled in 1985 in one of the country's most reputable families. The old woman who owns the house has a son named Rasheed. Rasheed was interested in Josephine who worked as a servant in their house and he married her with a secret marriage. Because the marriage of a Kuwaiti man and a foreign woman who was working as a housekeeper in Kuwait is accepted as a great shame that will cast a shadow on the dignity and honor of the family the marriage which was concealed by the couple inside and outside of the house, which could only come together with privacy has appeared after months. Rasheed -who was expelled from the house with Josephine- has temporarily found another house. Rasheed and his wife, who thought that his mother's attitude would change as their children were born have disappointed. Rasheed after realizing that his mother would never be satisfied, finally lost his ability to resist this crisis and sent his wife back to. With this development the problem of-identity crisis of Jose’s chracter is dealt with in a multi-faceted way. Jose, who left his age with his mother from Kuwait, had suffered from familial negativities that had passed through Kuwait years later in his twenties, and “familial negativities through his return to Kuwait and depressions caused by the sense of belonging. In an interesting coincidence when he met Gassân, one of the closest friends of Jose’s father in the Philippines, he returned to his dream Paradise ’Kuwait”. The journey from Jesus who has known as “Arabo to “Jesus” started with great hope because he was born from a Kuwaiti father in his own near the Philippines and likened to Arabs alike. But perhaps more of the crisis in the Philippines is waiting for him in Kuwait. Because his father was killed during the years when the Iraqi army occupied Kuwait. Although his father's mother welcomed Jose at first, exclusionary attitude towards foreigners in Kuwait caused her to take a negative attitude towards here grandson. The work is a continuation of the tradition of novels of criticism of the Arab society that has been going on for almost a century. The fact that novel was able to make deep psychological analyzes with his comprehensible language and simple style without being ambiguous and to keep the tension alive by leaving the problems at the end of the episodes and thus to provide immersion in this way reinforced the fictional soundness of the work. The novel also presents fictional material within the Arab society for the researchers in the field of religion psychology and sociology of religion, in order to show how a non-Muslim feels amoung the Muslim society. The principle of the best interests of children must be the main consideration in adjudicating applications for marriage dispensation. However, its implementation becomes problematic when faced with provisions on the ability to grant marriage dispensations for urgent reasons. This article examines how the best interests of children are implemented in legal applications for marriage dispensation in religious court. It employs a socio-legal approach with a maqāsid al-syarī'ah cum-mubadalah perspective. This article proposes that the principle of the best interests of children (...) is yet considered by judges effectively in deciding the cases. This does not reflect the protection of the child’s life, heredity, intellect, property, and religion, and does not consider the unique experiences of women both biologically and socially. Judges have a biased perspective in measuring the meaning of maturity and readiness of girls to marry, ignoring children's rights in education and reproductive health, and subordinate women in the spiritual realm. One of the important areas of study of religious psychology is to examine the reflection of worship in the spiritual life of individuals in the context of worship psychology. In this field survey, the relations between the level of meaning in life and hopelessness of individuals who performed the ʿUmra worship are examined. The study is conducted with 214 Turkish participants who performed ʿumra in Saudi Arabia. The collected data is analyzed by questionnaire technique. "Personal Information Form", " Meaning in (...) Life Questionnaire (MLQ)" and "Beck Hopelessness Scale" are used as data collection tools. The obtained data is analyzed in the SPSS 23.0 statistical program. One Sample t-Test, Pearson Moments Multiplication Correlation Analysis, Independent Sampling t-Test, One Way ANOVA and Tukey HSD tests are used to analyse the data. It is found that the research group's level of meaning in life above average; the level of hopelessness is below average significantly. There is a significant negative correlation between meaning in life and hopelessness, feelings about the future, loss of motivation, expectation about the future. There is a significant positive correlation between searched meaning and hopelessness and loss of motivation.Summary: Many religions have some types of worship involving visiting places considered as sacred and performing some rituals there. In Islam it is called ʿUmra, which is visiting the Kaʿba without being dependent on a certain time frame except for the pilgrimage month. There are certain rites to perform ʿumra, such as entering a state of iḥrām (ritual purity in which certain actions are not permissible), completing circumambulation, and saʿy (striving to do a certain act; walking) between the hills of al-Ṣafā and al-Marwa. ʿUmra worship is a comprehensive and versatile worship, which contains psychological, sociological, physical and financial characteristics.Studying the relationship between religious beliefs and practices, the religious rituals and their psychological effects and functions of ceremonies are the some essential research topics of Psychology of Religion. Existing research in this area usually reveals the existence of a positive relationship between the religious beliefs and practices and between meaning in life and hope. Individuals who believe in a religion can find a meaning and purpose in life through prayer and worship, and at the same time have more positive future expectation to endure the difficulties of life. Meaning and hope are intertwined, which complete each other. Hopelessness is closely related to depression and suicidal desire. There is a need to find meaning and purpose in life in order to hold on to life, and for looking to the future with confidence, and overcoming difficulties.It is known that people tend to be more religious and concentrating worship during periods of loss of meaning for various reasons. ʿUmra, which includes almost all type of worship, is a special worship, which has the potential to contribute to the individual's intense emotional life for gaining new awareness and developing different behaviours to cope with such difficulties. It is because the individual would have many experiences to see the cause of existence, the meaning of his/her life, and his/her future expectation during the ʿumra worship. Thus, he/she can overcome his/her hopelessness and loss of meaning and look to the situation from different perspectives. Therefore, in this study, the following questions are explored: Does ʿumra make a positive contribution to the psychological experience of the individuals, as expected? Does ʿumra has any effect on the level of loss of meaning and hopelessness that accompanies the psychological troubles? How does the demographic variables make difference in the level of meaning in life and hopelessness of individuals who perform ʿumra? In order to find answers to these questions, the relationship between the meaning of life - the hopelessness and the ʿumra was investigated. For this purpose, the meaning and hopelessness levels of the individuals who are performing ʿumra worship were measured by psychometric methods and the relations between them were analyzed. In addition, it has been tested whether there is a difference in the meaning in life and hopelessness according to demographic variables such as gender, marital status and educational status. 214 people aged between 18-82 years participated in the research. The survey data was collected from Turkish participants who perform ʿumra in the cities of Mecca and Medina in Saudi Arabia in May 2015. "Personal Information Form", " Meaning in Life Questionnaire (MLQ)" and "Beck Hopelessness Scale" were used as data collection tools. The obtained data were analyzed in the SPSS 23.0 statistical program. One Sample t-Test, Pearson Moments Multiplication Correlation Analysis, Independent Sampling t-Test, One Way ANOVA and Tukey HSD tests were used for the purpose of analysis of the data.The most important finding of the survey is meaning in life scores of individuals who are performing the ʿumra are above average (t = 20,50; p ˂ 0,01); and scores of hopelessness are below average significantly (t = -29,80; p ˂0,01). There is a significant negative correlation between presence of meaning subscale and hopelessness (r = -,288; p ˂ 0,01); and positive correlation between search for meaning subscale and hopelessness (r =,169; p ˂ 0,05) and loss of motivation (r =,285; p ˂ 0,01). The findings show that ʿumra can affect the meaning in life positively and the hopelessness negatively. There was no significant difference between the meaning in life scores and education level and gender variable (p ˃ 0,05). As the level of education increases, hopelessness scores decrease significantly (F = 2, 627; p ˂ 0,05). Hopelessness scores show a significant difference according to gender (t = -2,708; p ˂ 0,01). Men's hopelessness levels are significantly higher than women’s. Moreover, the meaning in life of married individuals is significantly higher than single individuals (F = 3,859; p ˂ 0,05). As the age and developmental stages progressed, meaning in life (F = 7,274; p ˂ 0,01) and hopelessness scores (F = 8,119; p ˂ 0,01) significantly increased.ʿUmra may have a rapid and intensive effect on the psychology of the individual and his/her sense of world. Relevant studies in the literature also imply such results. Since ʿumra is both a journey and a collective worship, it involves many types of worship, such as praying, reading scripture, repentance and so on. The findings of this study were discussed with reference to the findings about pilgrimage and the findings of study of meaning in life and hopelessness in different samples. On the other hand, the conditions in which the data collected, the study group chosen, the instruments and techniques used for this research constitute the limitations of the present study. However, the time period in which the worship was practiced and reaching the participants in these places of worship, and the measurement of the level meaning in life and hopelessness associated with their worship of ʿumra indicates the importance and originality of this research. The results can be used in other research projects. Studies on the different psychological effects of ʿumra worship can be enriched by longitudinal investigations. (shrink)

Background Social Egg Freezing (SEF), often promoted in Western contexts as a means to enhance reproductive autonomy, has seen varied uptake in countries with wider gender disparities. In such settings, where reproductive decisions are shaped by strong societal norms, SEF raises ethical concerns about whether it enables autonomy or reinforces prevailing expectations. Objectives This study examines how SEF is framed and regulated in countries ranking in the lowest quintile of the 2024 Gender Gap Index (GGI), where reproductive autonomy is emergent (...) and SEF is increasingly promoted as a demographic intervention. Methods A scoping review was conducted on SEF literature published between 2013 and 2025 across 29 countries in the lowest GGI quintile. English-language sources were retrieved from PubMed, while Japanese (J-Stage, Ichushi-web) and Arabic (Arabase [al-manẓūma], E-Marefa) were searched. Supplementary materials—including government policies, religious texts, and professional guidelines—were identified through Google Advanced Search, manual screening, and documents from the International Islamic Fiqh Academy (IIFA). Eligible sources included empirical and normative publications addressing SEF in the countries under review. Three reviewers screened and extracted data. Themes were developed iteratively. Results Sixty-eight sources met inclusion criteria and were organized into five themes: (1) awareness and education; (2) sociocultural and religious values; (3) policy and legal frameworks; (4) clinical practices and outcomes; and (5) commercialization and autonomy. Most sources (73.9%) focused on themes (2)-(4), while awareness (12.2%) and commercialization (13.9%) received limited attention. In most Muslim-majority countries reviewed, religious frameworks restricted SEF to married women. Turkey is a notable exception, permitting SEF for single women though embryo transfer requires marriage. Only 23 of the 68 sources were empirical, and just four employed qualitative methods. Conclusion Although SEF is often framed as empowering, this promise is context-dependent and frequently illusory. Cultural and structural constraints shape women’s choices, limiting the autonomy SEF claims to offer. Rather than imposing hegemonic neo-liberal assumptions, future policy and research should engage with local moral reasoning while examining how norms may reinforce inequality. Empirical studies are urgently needed to illuminate lived realities and improve policy development. (shrink)

This commentary offers an answer: Given their difference in investment/child, men are incentivized to renege on commitment more than women. Hence, women choose, ceteris paribus, to marry the most romantic man available.

This paper examines Ibn Taymiyya’s (1263–1328) critique of the Aristotelian logical tradition, with a particular focus on his theory of definition (ḥadd). Ibn Taymiyya argues that Aristotelian logic, premised upon fixed metaphysical categories, fails to serve as a practical instrument for epistemic inquiry and knowledge production, as it claims. Ibn Taymiyya’s critique can be divided into two main classes: general and metaphysical. His general criticisms undermine the validity of Aristotelian definitions through multiple dialectical arguments such as regress, disagreement, and redundancy, (...) showing that definitions are not epistemically useful. His metaphysical criticisms, on the other hand, strike at the foundations of Peripatetic metaphysics by rejecting the distinctions between a) quiddity and its existence, and between b) essential and concomitant predicates. I have also argued that Ibn Taymiyya’s position cannot be reduced to nominalism, empiricism, or conventionalism. Rather, his theory of meaning aligns more closely with modern pragmatics, wherein speech acts derive their meaning from their communicative, intentional, and contextual functions. (shrink)

One of the ṣaḥābīs of Prophet Muḥammad is ʿUrwa b. Masʿūd from the Ṭāʾif tribe of Thaqīf. He belongs to the Ahlâf part of the Thaqīf tribe and he is the ruler of this part. ʿUrwa’s ancestry is known without any controversy until Kasî (Thaqīf). According to a narrative his epithet was Abū Yaʿfur and another of his epithet was Abū Masʿūd. Father of ʿUrwa an important person too. He is one of the leaders of his tribe and he commanded (...) his part (Aḥlāf) in wars of Fijār. Mother of ʿUrwa is Subay’a bt. ʿAbd Shams from Banū Umayya. In this way ʿUrwa has kinship both with Banū Umayya and Prophet Muḥammad. So ʿUrwa has a very important position because of his lineage, his mother and father. Thefore, his connections with Mecca and Quraysh strengthens his position. In our sources there is no information about his dates of birth and death. It is likely to be over middle age when he became a muslim, considering that he was the leader of his tribe and his son become a muslim after he died. There is too little information about weddings of ʿUrwa. According to narratives, he had ten wives before becoming Muslim. After becoming a Muslim Prophet Muḥammad warned from him to prefer four out of ten wives. One of his four wives is the daughter of Abū Sufyān. Howev-er, there is no information about the names of his wives. Names of his sons: ʿĀṣim, Abū Murra, Abū Mulayḥ, Dāwūd, Hammām and Hishām and names of his daughters: Umm Saʿīd (married with Ḥaẓrat ʿAlī) and Ḥalīma. We could see he served as embassy before the treaty of Hudaybiyah. His embassy duty shows us the superiority of his position. Also, this embassy duty was very effective at peace negotiations. He mentioned kinship relations which connects about Mecca. He said that it could be beneficial to talk to Prophet Muḥammad himself. The Meccans mentioned about their trust in ʿUrwa. During the time of his embassy, he expressed that both sides should be away from war. In this context, he told the Meccans: The people around Prophet Muḥammad are very loyal to him and he told to Prophet Muḥammad: People around him could disintegrate easily. This mission shows us he is intelligent, respectable and had high persuasion skills. ʿUrwa, observed loyalty of ṣaḥābīs to Prophet Muḥammad. He confessed this loyalty can not be for any ruler. This observa-tion probably affected ʿUrwa’s conversion to Islam. Because of the conquest of Meccah and the events that followed, the people of Ṭāʾif were very worried. Because of this reason people of Ṭāʾif took part in the side of Hawāzin’s and they bat-tled with Muslims. In this time they sent ʿUrwa b. Masʿūd and Ghaylān b. Salama to the city of D̲j̲aras̲h̲ of Yemen, to learn about some war machines and techniques. Therefore they did not join wars of Hunayn and Ṭāʾif. Prophet Muḥammad ended the siege of Ṭāʾif and went to Medina. Meanwhile, ʿUrwa and his friend returned from Yemen. According to narratives when the Prophet Muḥammad returned Medina or he was way in Medina ʿUrwa visited him and became Muslim. Some people tell about the date of ʿUrwa’s being Muslim at before or after Abū Bakr’s emirate of Hadj. However, when the narrations are examined, it can be said he became Muslim after four or five months from Prophet’s siege of Ṭāʾif and before three or four months from Tabūk expedition of Rabīʿ al-awwal or “Rabīʿ al-ākhir” (July or August) in the year 9/630. As for the conversion of ʿUrwa, basic sources report that “Allah, inspired Islam to the heart of ʿUrwa and he changed his situation. He went to the Messenger of Allah and he became Muslim.” They do not give a specific reason. But after this period the narratives tell the reason for ʿUrwa’s becoming a Muslim as due to an experience he had while travelling to Najrān for trade. In this travel, two mysterious young girls and the priest in Najrān said the last prophet came and ʿUrwa must be subject to him and ʿUrwa became Muslim after he returned. But this narrative is prob-lematic with regard to evidence and text. After being Muslim, ʿUrwa wanted permission from the Prophet to invite his tribe to accept Islam. The prophet did not want to accept this at first. Because the people of Ṭāʾif had an arro-gant stance against Islam, and he said that the people of Thaqīf could kill ʿUrwa. Eventually ʿUrwa went to his hometown with permission of Prophet and invited people to Islam and they did not accept this invitation and cursed ʿUrwa. The next morning ʿUrwa read adhan of fajr and people of Ṭāʾif killed him. ʿUrwa b. Masʿūd was likened to Prophet Jesus by the Prophet Muḥammad. It is generally accept-ed that ʿUrwa b. Masʿūd el-Thaqafī is “one of the biggest from two cities” expressed in sūra Zukhruf. Only two weak narrations were reported of Urwa who could live as a Muslim for a few days and was matyred by his tribe. (shrink)

This article seeks to discuss the issue of being childfree from the perspective of the Qur’an. The topic has generated considerable debate within Indonesian society, making it essential to conduct further analysis, particularly within the context of a Muslim-majority country. Broadly speaking, public opinion is divided into two groups, each presenting its own arguments. Proponents of the childfree choice view it as a matter of personal autonomy, independent of religious norms. Conversely, opponents argue that the childfree lifestyle deviates from Indonesian (...) social norms, which emphasize that married couples should endeavor to have children. Given the complexity of this issue, this article employs Gadamer’s hermeneutical framework in conjunction with an exegetical approach. It argues that several Qur’anic verses implicitly reject the notion of voluntary childlessness. For instance, Surah al-A‘rāf (7:86) encourages the multiplication of offspring, Surah al-Nahl (16:72) praises the birth of noble descendants, and Surah al-Ra‘d (13:23) mentions that children may serve as a means for their parents to attain paradise. These verses indicate that Islam generally disapproves of married couples who deliberately choose not to have children. However, because the meaning of the text is dynamic and continuously engages in dialogue with contemporary social realities—such as the childfree phenomenon—new interpretations may emerge through a fusion of horizons. In this context, the childfree choice is not explicitly deemed _haram_ but may be tolerated if supported by valid reasons and if it yields certain benefits. (shrink)

The topic of The Prophets' Languages has led to a broad interest due to the sacred status of the Prophets. It has been of interest to people of all religious and social orientations. Despite the complexity of this topic and the necessity of studying it from various aspects such as archaeology and the study of ancient calligraphy, we limited our study to Islamic sources and references only. We extrapolated what was mentioned in these books. Other than the Holy Qur’ān, it (...) will be concerned with books of interpretation, history, biography, hadith, its explanations, language books, etc. This study has been divided into three main points, an introduction, and a conclusion. The first point dealt with the origin of the languages spoken by the Prophets (peace be upon them) and their proximity to each other: Syriac, Coptic, Hebrew, Aramaic, and Arabic. All of these languages belong to the Semitic language. In terms of their convergence and similarity with each other, some linguists considered it dialects of one language, the Semitic language of origin. It has branched out from it as a result of the expansion, development, and development of life. Looking at today, the dialects of the Arabs in Egypt, Morocco, Jazira, the Levant, and Iraq, each branched out and most of it emerged from the mother tongue Arabic. There is a discussion among researchers on which of the languages are closer to the Semitic language. Four languages are listed as possibilities: Hebrew, Babylonian, Assyrian, Syriac, and Arabic. The truth is that it is not easy to get to know the origin of the Semitic language, and everything that has been said is not outside the circle of speculation because of the loss of definitive evidence and the temporal dimension. As for the second point, this study investigated the linguistic geography that the Semitic language covered and spread in, by tracking the people who spoke the Semitic language, their places of residence, and their influence, as all of them settled in the Near East and its vicinity. If we look at the Semitic language, with its eastern and western branches, we see that it was concentrated in Babylon, Assyria, Mesopotamia, Arabia, Yemen, the Levant, and Jerusalem regions, and among the most famous tribes and nations that settled in this region are Saba, Himyar, Ad, Thamud, Jirhm, Samaria, Nabat, the people of Palmyra and others. Mostly likely, the Arabian Peninsula is the cradle of the Semitic people, although some say that Abyssinia was the cradle of the first Semites. In the third point, the number of prophets and messengers mentioned in the Noble Qur’ān was enumerated in clear terms. Among the twenty-five prophets are the following: Adam, Idris, Noah, Hood, Saleh, Lot, Ibrahim, Ismail, Ishaq, Jacob, Yusef, Shuaib, Ayyub, Dhu al-Kifl, Yunus, Moses, Aaron, Elias, Al-Isa, David, Solomon, Zakaria, Yahya, Jesus, and Muhammad (peace be upon them). The study of this point came by following the inductive and deductive approach, whereby the first approach is based on extrapolating the life of each prophet in isolation from others in detail, tracing his life, place of living, and residence, whom he married etc. The deductive method relied on deducing the language that each of the prophets (peace be upon them) spoke. Some prophets mentioned the name of the language in which he spoke in the Islamic sources. This study concluded that of the prophets mentioned in the Noble Qur’ān, seven of them spoke the Syriac language, three of them spoke the ancient Egyptian language (Coptic), eighteen of them spoke the Hebrew language, three of them spoke the Aramaic language, and nine of them spoke in Arabic. Some of the prophets spoke one language while others spoke more than one language due to their numerous travels and the people they interacted with. This study is considered a preliminary study to open the field for in-depth studies for researchers in this field, and every part mentioned in this research is suitable for being an independent scientific study in its own right. Background: The prevalence of diabetes is rising worldwide, especially in poorer nations. It is anticipated to emerge as the sixth main cause of mortality globally by 2030. The factors linked to self-awareness in diabetes patients are still debated.Aim: To identify factors associated with self-awareness among diabetic patients attending Al-Zaher primary health care center (PHCC), Makkah Almukaramah City, Saudi Arabia 2024Methods: A cross-sectional study was performed using a randomized sample of diabetes patients visiting Al-Zaher Primary Health Care Center in Makkah AlMukarramah (...) city. The used questionnaire included demographic information and data on the patient's beliefs and attitudes toward diabetes mellitus (DM). The statistical analysis was conducted using SPSS. A P-value below 0.05 was deemed significant.Results: The study included 523 patients with T2DM in different genders, age categories from 20 to 70 years and education levels. The majority of respondents were married (79.3%). 53.5% of respondents were fully informed of their health conditions, however 52% were not confident in managing their diabetes. 60% of patients stated that regular diabetic follow-up every one to two months would assist in maintaining their health. 50.7% of respondents said there is a significant likelihood of getting diabetic issues in the future. While 50.9% of respondents felt that diabetes may be remedied with medicine, 47% of them thought that those with diabetes would have a shorter lifespan compared to those without the condition. 48% of patients selected meals optimal for their health, whereas 51.6% engaged in exercise at least three times weekly to enhance blood glucose regulation. Nonetheless, 51.1% of them sometimes missed doses of diabetic medicine. The average total score of patients' self-awareness about diabetes mellitus was 6.8±3.9, with a median of 8 (range 1-13).Conclusion: The study found inadequate self- awareness among diabetic patients. Male gender, younger age and high education level are the significant factors associated with high self-awareness toward DM. The study highlights the need for educational programs to improve self-awareness and empower patients, especially females, older individuals, and those with lower education levels, in Saudi Arabia. In an anecdote in the Holy Bible, there is a rumor that because the Prophet David wanted to marry a woman named Bathsheba, whom he saw, he commissioned her soldier husband Uriah the Hittite to cause him to die in the most critical places of the army. In Islamic sources, some narrations originating from Isrāʾīliyyāt have been conveyed in many different ways. Likewise, in some Islamic sources, this incident, which is attributed to the Prophet David, was unfortunately also linked to (...) the marriage of the Prophet Muḥammad and Zaynab b. Jaḥsh. In addition, there is a claim that the Prophet Muḥammad sent Zayd b. Ḥāritha, who was Zaynab b. Jaḥsh’s ex-husband, to many wars and eventually caused his death in Muʾta war. First, the so-called incident between Prophet David and Uriah the Hittite will be discussed, and thereafter, Prophet Muḥammad and Zaynab b. Jaḥsh’s marriage will be thoroughly addressed in the study. In addition, it will be revealed that the incident that was attributed to the Prophet David was in no way similar to the incident of assigning Zayd b. Ḥāritha as a commander.Summary: According to a parable in the Bible, Prophet David sees a woman bathing while he was walking around the roof of his palace one night and he is impressed by her. Prophet David sends someone to investigate who this woman is, and as a result of the research, it is revealed that this woman is Bathsheba, the wife of Uriah the Hittite, one of the commanders of Prophet David. Prophet David sends someone to bring this woman and when the woman is brought to him, he commits adultery with her. The woman becomes pregnant after this affair and informs Prophet David about this situation. After receiving this news of pregnancy, Prophet David sends a message to the commander-in-chief, Joab, who is at war with his army, and asks him to send Uriah the Hittite to him. After hosting Uriah the Hittite in the palace for a few days, Prophet David sends him back to the front with a letter to be given to the commander-in-chief, Joab. In this letter, Prophet David asks the commander-in-chief, Joab, to send Uriah the Hittite to the most dangerous place in the war and to ensure that he is killed. Fulfilling the order stated in the letter of Prophet Davud, Joab sends Uriah the Hittite to a region where the war will be the harshest and causes him to be killed there. After the mourning of Bathsheba for her husband ends, Prophet David marries her. According to the Islamic belief, it is not possible for this incident to occur as it was mentioned in the Bible since the prophets were protected by Allah. It is because the parable states Prophet David committed adultery. In the Qur’ān, which is the source where we can get the clearest information about the incident, it is narrated inverses 21-25 of sûra Ṣād. Although there is a partial resemblance between the verses and the Bible, the verses do not mention either the woman or Prophet David’s sending that woman’s husband to the war because he wanted to marry her.In other Islamic sources, some relevant narrations originating in Isrāʾīliyyāt are narrated in many different ways. Our tafsīr scholars did not approve these narrations originating in Isrāʾīliyyāt. Also, they stated that the narrations expressing that Prophet David sent Uriah the Hittite to the war for his killing were not true and that such a situation would not be suitable for a prophet or even for a Muslim.In the same sources, many different possibilities were voiced in order to resolve the situation and this incident, which was attributed to Prophet David, was tried to be placed on a more reasonable ground. As a result of these efforts, the marriage of the Prophet Muḥammad and Zaynab b. Jaḥsh has been linked to this incident in various ways.Although it is not possible to give a certain date of the marriage of Zaynab and Zayd b. Ḥāritha, it is seen that this marriage occurred with the help of the Prophet Muḥammad in the first year of the emigration to Madinah. The marriage of the Prophet Muḥammad’s aunt’s daughter and Zayd, a freed slave, was for eliminating the discrimination between free individuals and slaves that existed in the society.There is not any serious problem about the marriage of Zayd and Zaynab at this point. However, at the point of ending this marriage, there are some narrations in our sources, and these leave the Prophet Muḥammad under suspicion. According to these narrations, the Prophet Muḥammad went to Zayd’s house to meet him and the Prophet Muḥammad called out to Zayd from outside the house. For not keeping the Prophet Muḥammad outside, Zaynab opened the door and invited the Prophet Muḥammad in by stating that Zayd was not at home although the clothes on her were not suitable. As soon as the Prophet Muḥammad saw her, he immediately turned his head and because he liked Zaynab, “I exonerate almighty Allah. I exonerate Allah that has turned the hearts.” he grumbled. After a while, Zayd came home and learned what the Prophet Muḥammad said. He immediately went to the Prophet Muḥammad and said “Messenger of Allah! May my mother and father be sacrificed for you. If you liked Zaynab, let me divorce her for you.” However, the Prophet Muḥammad advised him not to divorce his wife. As far as we can find in our sources, there are two other similar narrations.These narrations contain many problems in terms of both isnād and logical consistency. When we examine at the narrations in terms of isnād, we see that all three narrations are mursal. We can say that this is the first factor that reduces the reliability of narrations. Secondly, all narrations have at least one narrator accused of weakness or even dishonesty. Therefore, it is not appropriate to base a serious claim about the Prophet Muḥammad on such weak narrations. In addition, the rumor that the Prophet Muḥammad liked Zaynab, his aunt’s daughter and a married woman, and wished that she would divorce her husband has no reasonable logic. The fact that the marriage of Zayd and Zaynab ended quickly was mostly caused by Zaynab’s harsh temperament. Moreover, although Zaynab did not want this marriage, she could not oppose the order of the Prophet Muḥammad due to the verse about her. For these reasons, Zaynab could not get along with her husband and she was constantly reflecting her dissatisfaction with this marriage on Zayd. Therefore, Zayd constantly complained about Zaynab, but the Prophet Muḥammad gave Zayd the same advice every time, commanding “Keep your spouse with you, do not leave her!” Although the Prophet Muḥammad constantly banned Zayd, he could not stand Zaynab anymore and divorced her. After he divorced Zaynab, verse 37 of sûra al-Aḥzāb was sent down. Thus, the marriage of the Prophet Muḥammad and Zaynab took place as a result of a divine will.There is also a claim that the Prophet Muḥammad sent Zayd, the ex-husband of Zaynab, to many wars and consequently caused him to be killed in Muʾta war. When we examine the dates of the nine military expeditions, in which the Prophet Muḥammad appointed Zayd as a commander, it is seen that the first expedition was held on 3/624 while the others were held after 6/627. Therefore, at least eight of the nine expeditions in which Zayd served as a commander were taken place after the marriage of the Prophet Muḥammad and Zaynab. Consequently, in the light of this information, it is clear that the fact that Zayd was appointed as a commander is not similar to the situation in narrations about Prophet David. (shrink)

Kin marriages have been a subject of literary, historical, sociological, religious, and medical studies from past to present. Such a marriage has been discussed within the science of fiqh in terms of religion. Ḥanafī and Mālikī mujtahids stated that this marriage is permissible. While Shāfiʿī and Ḥanbalī mujtahids did not recommend kin marriage by seeing it permissible. Based on the fundamental doctrines of Islamic law, they argued that marrying a foreign candidate is mustahabb and answered the related criticisms against their (...) fatwa. In scientific studies, genetic risks in kin marriages were found to be twice as high. Therefore, the kin marriage was not recommended and it is suggested that those who will marry with relatives should undergo carrier tests. In some contemporary religious studies, it has been argued that the families established by kin marriages are stronger, the genetic research does not have absolute precision, and it may be ideological in the form of weakening the family-society structure. Besides, the ijtihads distant to close kin marriage is weak in terms of evidence and opposing evidence has been put forward to defend kin marriage. On the other hand, in some sociological studies, it has been argued that kin marriage is predominantly caused by religion and that it wekaned the social solidairty. This study analyzes the classical and contemporary approaches to kin marriage in detail within the framework of thesis-antithesis in terms of fiqh, uṣūl al-fiqh, and evidence, and evaluates such studies from a fiqh point of view by including medical research results and some sociological studies on kin marriage. A generally accepted deterministic link cannot be established between kin marriage and genetic disorders. Because, the same risks are found in marriages with foreigners and also arise from harmful substance addiction. However, the genetic risk rate in marriage with close relatives is twice that of marriage with a foreign candidate. The least of the two possible losses is preferred. So it is very sensible that a marriage that is twice as likely to take such a risk should not be recommended by religion. Because, the main purpose of religion in marriage is to protect the generation and ensure its continuation. The fact that such a marriage is not religiously prohibited does not mean that it was recommended. Because it is left to individuals and public authority to limit the ibaha on the grounds of maṣlaḥa. On the grounds that the hereditary risk rate is high, kin marriage is not recommended in the fiqh and an effort has been made to prevent such a marriage from becoming widespread. Sociologically, marriages with a foreign candidate who is equivalent to a close relative are more appropriate in terms of strengthening the social organization. It is seen that Shafi'i and Hanbali ijtihad, which do not recommend close relatives marriage, are supported by current medical and genetic research. It is understood that the ijtihads that does not recommend marriage with close relatives is inaccurate in terms of evidence, and the views that argue that such marriages are stronger in terms of benefits are not in place. In general, it is seen that religion is distant from kin marriage, and such marriages are mostly caused by psychological, sociological, and cultural reasons. The fact that such marriages are common in areas belonging to the Shāfiʿī and Ḥanbalī schools that do not recommend marriage with close relatives, on the other hand, the fact that marriages between close relatives are less in Hanafi regions, which state that the same marriage is only permissible, supports this. In this respect, some claims arguing that such a marriage stems from religion based on the understandings that refer to that kin marriage is recommended by religion, are not accurate. For this reason, it is difficult to establish a connection between the disintegration of social unity, the spread of hereditary diseases, and the claims that religion recommends consanguineous marriage. Today, enlightening the religious aspect of kin marriage will be beneficial in protecting society against hereditary risks. (shrink)

The Fatwā-house, which was within the body of Meshihat in the Ottoman Empire, gave answers to the questions posed to it by focusing on the Hanafi sect and the preferred fatwās of this sect for centuries. These questions and answers were also duly recorded. In this study, based on The Record for the Legal Responses of the Supreme Fatwā Office, which is registered at records numbered 378 in the Meshihat Archive of the Istanbul Mufti, one of the records containing the (...) answers given by the institution. It is an attempt to create an imagination about the scope and sphere of influence of the fatwā activity in the last period of the Ottoman Empire. Accordingly, in the last thirteen years of the state, Fatwā-house has been the addressee of questions from individuals, state and private institution directors, societies, ministries and the Grand Vizier. While some of these questions came from the provinces within the Ottoman borders or from the countries that had an administrative ties with the Ottoman Empire, some of them were submitted to the Fatwā-house by the Muslims of other states from the lost lands or simply because the caliphate center was the official fatwā organ. At the records, there is also a record of the questions coming from muslims who are Ottoman citizens but residing in other countries. Looking at the subjects, it was determined that most of the questions were asked about foundations. In addition, the permissibility of obtaining interest by bank facility or depositing money in the bank, the establishment of modern schools and whether the ways to create resources for these schools are permissible, whether teaching in Latin letters is possible, the provision of life insurance, the importance of cleanliness in the fight against cholera, the fight against innovations (bidʻas) in mosques. It is seen that questions on different issues, from issues such as whether the wife of the lost (mafqud) can be separated by the judge or not; to the issues of whether the fulfillment of judgment can be regarded as the end of the judgment or not. As it is mentioned in some fatwā records at the record book, it is obligatory to decide on fatwā and its fulfillment in the Ottoman Empire with the most authentic and preferred view of the Hanafi sect. The last two fatwā questions mentioned above are handled as examples of giving up the act with the will of the head of state, with the preferred fatwâs discussed in this article. It is only possible with the will of the head of state to make a decision with an opinion other than preferred fatwâ or an other opinion out of the sect. According to the first example, some of those of the citizens of other states outside the Ottoman Empire came to the Ottoman lands for reasons like trade etc. and married to Muslim women there and then left them suffering. This was also true for the wives of men who went to wars and did not return. Although the drawbacks of the Hanafi sect's preferred view, that one should wait until the age of ninety, one hundred, one hundred and twenty, or until the death of their peers, were resolved by appointing a regent from other sects, continuity could not be ensured in this practice either, finding people has not always been possible. For this reason, in the time of Shaykh al-Islam Hayri Efendi, a statement of change was prepared and submitted to the will of the sultan. In the issue of whether the signature of the head of state can be counted as the end of the judgment, another subject in which the will of the head of state is applied, the stages of abandoning the preferred view can be followed much more clearly. In the case of the dismissal of the judge or the expiration of the term of office before the execution of the judgment, especially in the distant provinces of the state, in the case of the judge's dismissal or the expiration of his term, according to the preferred view of the sect, which was based on juristic discretion, the closure of the cases took many years. It is seen that the judgment reached by analogy was submitted to the will of the sultan, with an article added to the script regarding the prepared procedure of reasoning, although there is no preferred view since it is the most suitable opinion for the interests of the people and the necessities of the century due to the increase in complaints. Effective from the time it was approved by the head of state, the execution of the sentence is no longer a requirement for the trial to be completed. The changes in the provisions of these matters also show that, although it was important for the Ottoman State to comply with the preferred view of the Hanafi sect - as in the previous Shaykh al-Islams' fatwās in the form of ma'ruzat - it was considered more necessary to look after the interests of the Muslims and different opinions were enacted and put into practice. Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Islamic law accepts the institution of polygyny as a substitute provision if it fulfills the certain conditions and reasons, -and limited the maximum number of wives to four. Although polygyny is mubah (permissible) in Islamic law, it is not an absolute right that every man can use arbitrarily. Thus in Islamic law, the legitimacy of polygyny has been attributed (...) to the presence of two basic conditions: the observance of justice among co-wives and providing maintnance. However, the observance of these conditions that is left to the mercy of men leads to the exploitation of the right for practicing to polygyny and victimization of the first spouse. Therefore, inserting some restrictions for using this right has come to the agenda from time to time in Islamic legal history. The first legal arrangements concerning the restriction of the polygyny (taaddud al-zawjāt) in the history of Islamic law were indirectly made with the Family Law Decree of 1917 which was prepared in the last periods of the Ottoman Empire. Among the late Islamic jurists, the issue of the limitation of polygyny by public authority in Islamic law continues to be discussed. The civil laws of contemporary Muslim countries contain different regulations on the issue. In this article, the restriction of polygyny by the public authority in Islamic family law will be focused on.Summary: Polygyny, the marriage of a man with more than one woman at the same time is a well-known practiced in human history. Although polygyny is legally permissible (mubah) in Islamic law it is not an absolute right that every man can arbitrarily use. Thus in Islamic law, the legitimacy of polygyny has been attributed to the presence of two basic conditions: the observance of justice among co-wives and providing maintenance. On the other hand, there may be some exceptional circumstances permitting polygyny in Islamic law. For example, when female population is much more than male in the society and when a, woman is can not fulfill her family duties due to her cureless illness, polygyny is permitted in Islamic law.As it can be understood from the explanations above, polygyny in Islamic law is not a general and mandatory provision that should be applied by every man who has legal capacity to marry. On the contrary, it is an exceptional provision that is justified if there are certain conditions and justifications. According to this; polygyny is a moral and legal institution that is made up of mutual consent based on individual and social conditions and needs in Islamic law. Therefore, men do not have to marry a second woman on their current wives, as well as women have the right to say “no” to marry a married man as a second wife.When the conditions and rationales indicated in the relevant verses and doctrine are evaluated together, it can be said that in order to be able to legitimize the polygyny in Islamic law, there must be three basic conditions:(1) Observing justice among spouses, (2) Having sufficient financial power to provide maintenance for spouses, (3) Existence of individual or social need or necessity.Therefore, in order to prevent the exploitation of polygyny, which is justified under certain conditions and justifications in Islamic law, the above-mentioned conditions must be fulfilled. Otherwise, polygyny can cause some problems, unrest and injustice for individual, family and society. Hence, in the presence of certain conditions and justifications, polygyny accepted in Islamic law as a moral and legal institution aiming the elimination of individual and social arbitration.Although the legitimacy of polygyny in Islamic law depends on the existence of certain conditions and special circumstances, it is a known fact that they are not always observed in practice. It can be said that the right of polygyny is a subject of abuse in practice. Therefore, the limitation of polygyny by the public authority has come to the fore in Islamic legal history. Today, control of the public authority and inserting some restrictions of polygyny continue to be discussed among the Islamic jurists. In the past, it is possible to say that the control of the exercising of this right has been done relatively by society (social environment). However, nowadays, since the society cannot perform the control mechanism, it is brought up by the state (public authority) on behalf of the society.Among the contemporary Islamic jurists regarding the supervision or limitation of polygyny by the public authority; there are two approaches: “those who accept” and “those who do not accept” such restrictions.Islamic jurists, who accept that public authority is allowed to intervene in polygyny, grounded their views on two perspectives: The first is that the polygyny is legally permissible and the public authority has the authority to limit the permissible (mubah) in Islamic law. The second is that polygyny is restricted with the conditions in the Qur’anic verses such as “husband’s observation supervision of justice among his wives” and “having the power for ensuring the livelihood (nafaqa) of his wives” and it is more appropriate for the benefit of society and the purpose of the legislator (Shari’) to be subject to the control of the public authority whether these conditions are present or not. Islamic jurists, who do not agree that the public authority has the right to intervene in polygyny grounded their views on two perspectives as well: First, polygyny is a legitimate right mentioned in the verses in Islamic law and there is no definite proof that this can be prohibited or restricted by the public authority. Secondly, it is contrary to the verses to prohibit or limit the right that the Qur’an makes legitimate (free).Thus, it is possible to say that the opinion which accepts that the public authority has to limit polygyny is more accurate in terms today’s social conditions. Namely, polygyny is linked to two basic conditions: ”husband’s observance of justice among his wives and having the power to provide maintenance for his wives. Therefore, supervision of the public authority on checking the existence of these conditions is more appropriate for the purpose of the legislator (Shari legitimizing polygyny and social benefit.In fact, the Ottoman Family Law Decree of 1917 indirectly limited the right of the husband to marry more than one woman, giving the woman right to stipulate a condition in her marriage contract that her husband not to marry a second woman. In the 1924 Draft of Family Law Decree, which was prepared after the repeal of the Family Law Decree of 1917, but not enacted, it was proposed that the application of polygyny should be presented to the approval judge.In today’-s Muslim countries, there are three different practices: namely “completely prohibiting polygyny”, ”releasing polygyny” and “giving the court the right to monitor the existence of necessary conditions “. In countries such as Morocco, Algeria, Iraq, Syria, Indonesia, Malaysia (and Pakistan), the validity of polygyny depends on the permission and supervision of the judiciary. Some of these countries which have accepted judicial review have given the judicial control for the requirement of justice, some of them the conditions of justice and maintenance some of them for the conditions of justice, maintenance and a legitimate justification.In sum, in accordance with the provisions of the relevant verses, polygyny in Islamic law is legitimately permissible (mubah). However, the public authority has the right and authority to limit the mubah in Islamic law in the case of the elimination of damage and the necessity of the public interest. On the other hand, the public authority has the right and authority to enact the law in Islamic law by preferring one of the existing ijtihads that meet the needs of the society and conforms to the conditions of the age.According to this, when the public authority made a statutory regulation that links the use of right of polygyny to the permission of the judge, this regulation is binding on society.Therefore, in the event of such a legal arrangement, it is possible for the public authority to allow the men who comply with the conditions and not to allow the ones who are not to comply with the conditions after conducting the necessary investigation. As a matter of fact, now Family Laws of many Muslim countries now include such legal arrangements. It is also worth mentioning here that there may be a necessity for a man to marry more than one woman (up to four) at the same time in terms of social benefits, when the population of male and female in a society is excessively disproportionate. In such circumstances, it is also possible that the public authority encourages, or even mandates, the marriage of men who have fulfilled the conditions to more than one woman. (shrink)

This article discusses the changing role of women in the family household to take full control and responsibility as a single parent due to the death of their husbands in the post-Covid-19 pandemic in Indonesia. Based on the Covid-19 pandemic data, the death of husbands is so high in East Java that raised new problems in the family household when a wife must switch her position to take role as the head of the family as a single parent. This article (...) strives to answer the questions of what roles do the women play as the head of the household due to the death of their husbands? How are these roles perceived based on Maqashid Al-Syari’ah, a contemporary Islamic law? These questions aim to understand the transformation of roles between husband and wife in Javanese Muslim family households to portray the gender equality and the construction of the family resilience. The data of this study are collecter through ethnographic fieldwork with participatory observation and in-depth interviews to several married women in eastern parts of Java. This article suggests that mainstreaming the method of Islamic law, Maqashid Al-Syari’ah to build the resilience of single-parent families in East Java is realized by the awareness of single-parent women in meeting the family needs. This awareness is employed through various practices by women in East Java who cover all domestic and public activities for the benefit of the family. (shrink)

The concubines, with whom the sultans lived a family life, were classified according to a certain hierarchy in the Harem. The first wives of the sultan and those who gave birth were called Kadınefendi. The other wives with a lower status than the Kadınefendi wives were called Ikbal Hanımefendi. According to Islamic law, marriage with a concubine is not like a marriage with a free woman. If a marriage is desired, the concubine must be freed. Until the 19th century, sultans (...) did not marry their concubines for a few exceptions. In the 19th century, the legal status of concubines in the Ottoman Empire became controversial. The countries of origine changed when the Ottoman Empire was unable to conquer new territory. Consequently, the enslavement procedure of prisoners of war disappeared. Instead, Caucasian immigrants, who had to leave their homeland mainly due to the Russian attacks, gave their daughters to the Ottoman palace so that they would not suffer misery and could reach important positions in the future. Among these were orphans from poor families as well as those from noble Caucasian dynasties. Even though the young women in the palace were called concubines, at least some of them were free/Muslim persons. This meant, that they could not be enslaved according to Islamic law. Although there was no problem for those who served in the palace, a remarkable situation emerged for the would-be spouses of the sultan. Could a woman from a free and Muslim family be the sultan's wife without a marriage bond? Was the limitation of the Kadınefendi numbers to four (in times of Sultan Abdülaziz) due to the Islamic law principle, that a man could marry maximum four wives? Was there a marriage ceremony (nikāh) for Kadınefendi wives? What was the situation of the Ikbal? Satisfactory answers to these questions have not been given yet. However, there are no official records it was claimed that lately sultans married especially their concubines who were Abkhaz descendants and included them among their wives in this way, because they were free and Muslims. Thus, the matter whether Sultan Abdülhamid II's wives were concubines or wedded became the subject of some research today. Memoires claim that almost all of Sultan Abdülhamid's wives were free and of Muslim origin. According to this, it was said that the wives of Sultan Abdülhamid could not have the status of the concubine and that their relationship should have been by marriage. On the other hand, considering that a maximum of four women can be married according to Islamic law, the marriage of the Sultan, who had thirteen wives, raised juristic questions. This problem was most clearly seen in the inheritance case filed by his heirs after the death of Sultan Abdülhamid. In this case, where it was claimed that Sultan Abdülhamid was married to nine wives, no objection was made to that claim. In this study, information about the wives of Sultan Abdülhamid and their legal status was tried to be determined through the documents related to their salaries during the 2nd Constitutional Era. Besides, the issue of nine wedded women, which emerged in the case of Sultan Abdülhamid's inheritance, was evaluated in terms of fiqh (Islamic jurisprudence). Sultan Abdülhamid was never accused of marriages contrary to Islamic law by his opponents during and after his reign. From this point of view, it can be said that there was no situation contrary to Islamic law regarding the Sultan's harem at that time. This might be due to three possibilities: Firstly, some wives have concealed the truth in the court, which is the weakest possibility according to the data obtained. Secondly, the talaq (divorcement) was hidden by Sultan Abdülhamid and his wives were not aware of it. This possibility has been found to be problematic when evaluated in terms of Hanafi fiqh. Thirdly, the practice of al-nikāh al-tanazzuhī (marriage performed in order to avoid from fornication). Considering the correspondence between the state departments in the period starting with the 2nd Constitutional Monarchy and until the Republic, it is clear that the Kadınefendis were regarded as married wives (their number was limited to four), while the Ikbals were regarded as concubines. From this point of view, it is thought that the most plausible possibility is that the Ikbals were regarded as concubines and their marriages were al-nikāh al-tanazzuhī. (shrink)

Abū Lahab (d. 2/624), one of the notables of Mecca, was one of the Prophet’s four uncles who reached the Islamic period. Abū Lahab who had generally good relations with the Prophet before the Islamic period developed bad attitudes towards his nephew when his prophethood was proclaimed and maintained these until his death. He, known for loyalty to his ancestor’s religion, did not believe in his nephew’s prophecy and was one of the chief antagonist and enemy of the Prophet in (...) Mecca. In addition to the fact that Abū Lahab had an identity devoted to his ancestor, by force of emphasis of social justice, the Prophet’s new religion defending equality among people and ordering to the faith of afterlife caused to have a strong opposition to his nephew. In the development of Abū Lahab’s opposing attitude his wife Umm Jamīl (d.?/?) plays a crucial role. In this article, Abū Lahab and the reasons which prompted to oppose to the Prophet and his religion were examined in detail. In addition, his life and relations with the Prophet before and after nubuwwa were detailed.Summary: bū Lahab is one of the four uncles of the Prophet Muḥammad, who reached the time of his prophethood. There is no information in the sources related to his birth, childhood and youth. His real name is known as ‘Abd al-‘Uzzā, and his nickname is Abū ‘Utba or, according to a weak opinion, Abū ‘Utayba. In most of the sources, it is noted that the (second) nickname of Abū Lahab was given by his father because he was so handsome, that he was shining like a fire or his cheeks were reddish as if they were fevering. Detailed information about Abū Lahab belongs to the post-prophetic period; information about his life before prophethood is less. Among these rare information there are findings that he was among the richest and most respected people of Mecca; saved by paying his diet a Meccan aristocrat who was held hostage by a caravan he met on the road to Mecca- al-Ṭāʾif; was involved with his friends in the theft incident against the golden gazelle statue in the Kaaba to supply his drinking money. The sources record that he was delighted with the birth of the Prophet and allowed his concubine to breastfeed the Prophet. Relations with the Prophet during this period, except for the anger of the Prophet because the supported Abū Ṭālib (d. 619) in a fight with Abū Ṭālib, generally followed a positive course. So much that he asked the two daughters of the Prophet to marry his two sons. However, these positive relations were broken and replaced by hostility after the Prophet was given the duty of prophethood and the Messenger of Allāh started to serve this duty.Abū Lahab, who can be regarded as a filiopietist, made every attempt to eliminate this new belief, which he saw as contrary to his ancestors' beliefs. He watched his nephew, did everything he could to deny what he was saying and prevent him from getting a response. He would grind him by throwing feces, carrion, animal droppings and stinking things to the door of his house to disturb him. He did not hesitate to increase the severity of this hostility. So much that he was among those who sentenced him to hunger by applying a socio-economic boycott to Muḥammad and his close relatives, Banū Hāshim and Banū Muṭṭalib, who supported him. However, in the pre-Islamic period, a sense of tribalism was dominant in Mecca and its nearby basin. This understanding was also dominant in the lower arms of the Quraysh tribe, who was a resident of Mecca. These communities, especially Banū Umayya and Banū Makhzūm, who represent the Mecca aristocracy, strongly opposed the prophecy of one of the Banū Hāshim. On the other hand, the Banū Hāshim adopted the Prophet with the same understanding. However, there was only one person who acted against this understanding among all Banū Hāshim, and this was Abū Lahab. He treated his nephew so much in hostility that he became the only person among the Mecca polytheists who was condemned by the Qur'ān. Perhaps the most important and influential factor in his persistence in a stubborn and systematic opposition to the Prophet, was his ancestral identity. In addition, in the pre-Islamic Mecca, the people were divided into social strata, inequality among people, and the aristocratic segment was the highest level of society. Islam advocated equality among people due to its vision of social justice. The Mecca aristocrats, including Abū Lahab, considered themselves superior to other people and thought that they were in no way equal to those who were lower in terms of property, position and nobility. This understanding was one of the most important factors that enabled Abū Lahab to take place in the block against this new belief system communicated by the Prophet. Again, one of the important factors in his displaying a stubborn and systematic opposition to the Prophet is that Islam accepts the belief in the hereafter as one of the basic principles of religion. Like the other polytheist Meccans, Abū Lahab did not believe in the resurrection. His wife Umm Jamīl was another factor of his opposition stance. The traditional rivalries between Umm Jamīl’s family Banū Umayya and Abū Lahab’s family Banū Hāshim, lead to a sense of competition against. This feeling prompted her to oppose the prophecy of one of the Banū Hāshim. So she always provoked her husband and Abū Lahab’s hatred toward his nephew never stopped to such an extent that it was mentioned in the surah Tabbat/al-Masad by a metaphor of carrying wood to feed the fire of hatred. Actually it was only Abū Lahab who was hostile to Muḥammad's prophethood among all the Banū Hāshim. With the prophethood of Muḥammad, beginning to display a stubborn and systematic opposition to Islam, Abū Lahab continued this opposition intensely in the following periods and died in the second year of the hijra with this attitude. His wife, Umm Jamīl, died with the same understanding and shared the same contractual fate with him. However, all her children -except for ‘Utayba (d.? /?) - were honored with Islam and were among the Prophet's distinguished companions. (shrink)
